Shipping Terms

Unless otherwise agreed to in writing, all shipping is at the expense of the Buyer. APW Company reserves the right to ship products freight collect and to select the means of shipping and routing. All shipments are F.O.B. carrier at APW Company's place of manufacture or warehouse location: 2400 Stafford Ave STE 500, Scranton, PA 18505.

Risk of Loss

Risk of loss or damage passes to the Buyer upon delivery of products to the transportation company at the FOB point. Confiscation, destruction of, or damage to products does not release or reduce the liability of the Buyer.

Insurance

APW Company may insure to the full value of the products at the time of delivery. All freight and insurance costs are for the Buyer's account. If Buyer has not been notified of existing insurance coverage and provides its own insurance for a shipment, APW Company will waive its insurance charge.

Shipment Schedules

APW Company will attempt to meet all shipment schedules. However, any shipment quotation or forecast is only an estimate of the time required to make shipment. APW Company will not assume liability, consequential or otherwise, for any delay or failure to deliver for any reason. APW Company reserves the right to allocate inventories and current production as it deems necessary.

Packaging

The cost of packaging for normal domestic shipment is included in the invoiced price. Where special domestic or export packaging is specified involving greater expense, an additional charge will be made to cover such extra expense.

Governing Law

This policy is governed by the laws of the Commonwealth of Pennsylvania. Any disputes shall be subject to the exclusive jurisdiction of the courts of Lackawanna County, Pennsylvania.
